These Terms of Service ("Terms") govern your use of the StillDew service ("Service") operated by Disruptive by Design ("Company", "we", "us", "our"), a company with offices at 7C Mani Square, 164/1 Maniktala Main Road, Kolkata 700054, India.
By accessing or using StillDew, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
The service
StillDew allows users to create time-delayed messages ("dewdrops") containing text, images, audio, and video content, and schedule them for delivery to specified recipients at future dates. The Service includes content storage, scheduled email delivery, and guardian backup delivery.
Account registration
To use StillDew, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years of age to use this Service.
Acceptable use
You agree not to use StillDew to:
- Send content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Send unsolicited messages or spam to recipients who have not consented
- Impersonate any person or entity
- Upload content that infringes on the intellectual property rights of others
- Upload viruses, malware, or any harmful code
- Attempt to gain unauthorized access to the Service or its systems
We reserve the right to remove content or suspend accounts that violate these Terms, at our sole discretion.
Content ownership
You retain full ownership of all content you upload to StillDew. By using the Service, you grant us a limited license to store, process, and transmit your content solely for the purpose of delivering your dewdrops as scheduled. We do not claim any ownership over your content.
Payment and pricing
StillDew charges a one-time fee per dewdrop as listed on our pricing page. All payments are final and non-refundable, except where required by applicable law. Prices may change, but changes will not affect dewdrops already purchased.
Delivery
We make every reasonable effort to deliver your dewdrops on the scheduled date. However, we cannot guarantee delivery due to factors beyond our control, including but not limited to: invalid or changed email addresses, recipient email server issues, or technical failures. The guardian delivery feature is provided as a best-effort backup.
The forever pledge
We are committed to delivering every sealed dewdrop. In the event that Disruptive by Design ceases to operate the StillDew service, we will make commercially reasonable efforts to deliver all pending dewdrops before shutting down.
Limitation of liability
To the maximum extent permitted by law, Disruptive by Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid for the specific dewdrop in question.
Indemnification
You agree to indemnify and hold harmless Disruptive by Design, its officers, directors, and employees from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after modifications constitutes acceptance of the updated Terms.
Governing law and jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Kolkata, West Bengal, India (Honourable Kolkata High Court).
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
